1. Publisher

This website and RADAR software are published by AKIOUD AI, a French simplified joint-stock company (SAS) registered with the RCS Paris under SIREN 924 929 730, with its registered office at 8 B RUE ABEL, 75012 PARIS 12, France. VAT number: FR24 924 929 730. Publication director: Abdeljalil Jliouat, President.

2. Acceptance of terms

By accessing this website, requesting a trial, or using RADAR, you accept these terms and our Acceptable Use Policy. If you do not agree, do not use the service. These terms may be updated at any time. Continued use after an update constitutes acceptance of the new terms.

RADAR is a B2B product intended for organizations. If you are a consumer acting outside your trade, business, or profession, these terms apply to the extent permitted by applicable consumer protection law.

3. Service description

RADAR is a self-hosted AI compliance evidence platform. You download, deploy, and operate RADAR entirely within your own infrastructure. AKIOUD AI provides the software and documentation but has no access to your infrastructure, your data, or your evidence chain. RADAR is not a cloud service — it is a software product you run yourself.

The Client retains exclusive responsibility for the protection and regulatory compliance (GDPR, EU AI Act) of all data processed through RADAR. AKIOUD AI has zero access to client data — RADAR operates entirely within the Client's infrastructure. No data leaves the Client's network through RADAR.

4. License

RADAR is provided under a commercial license, materialized by a cryptographic key (JWT signed RS256). The license grants you a non-exclusive, non-transferable, time-limited right to use RADAR for your organization's internal compliance operations for the duration of your subscription. Redistribution, sublicensing, or resale is prohibited without explicit written permission. Upon termination of your subscription, you may retain access to previously collected evidence in read-only mode. All rights not expressly granted are reserved by AKIOUD AI.

5. Service continuity

In the event of a failure in RADAR's compliance engine, the Software continues to operate in degraded mode. Read operations (GET) remain available to preserve access to compliance evidence. New evidence collection may be paused during the failure period. AKIOUD AI shall use commercially reasonable efforts to restore full functionality without undue delay. AKIOUD AI is not responsible for the absence of new compliance data during failure windows.

6. Intellectual property

All intellectual property rights in RADAR, its source code, architecture, documentation, and compliance logic remain the exclusive property of AKIOUD AI. The AKIOS OSS and EnforceCore open-source projects are licensed separately under their respective open-source licenses. Nothing in these terms grants you any ownership of RADAR's intellectual property.

You may not modify, reverse-engineer, decompile, disassemble, or extract the Software. The following are expressly prohibited:

Any violation exposes you to prosecution for counterfeiting under Articles L.335-2 and following of the French Intellectual Property Code, as well as damages for unfair competition.

• The use of generative artificial intelligence tools to analyze, reproduce, or reconstruct the business logic, compliance scoring algorithms, or PII detection rules of the Software.
• The creation of derivative works incorporating the compliance logic extracted from the Software.
• The distribution, sale, or provision of any compliance system substantially reproducing the internal logic of the Software.

7. Your responsibilities

You are responsible for:

• Deploying and operating RADAR in a manner consistent with applicable laws and regulations, including the GDPR and the EU AI Act.
• Maintaining the security of your infrastructure where RADAR is deployed.
• Ensuring that your use of RADAR complies with the EU AI Act when deploying AI agents in regulated environments.
• Not using RADAR for any unlawful purpose or in a manner that could damage AKIOUD AI's reputation.

8. Disclaimer of warranties

RADAR is provided "as is" and "as available" without any warranty of any kind, express or implied. To the maximum extent permitted by law, AKIOUD AI disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

AKIOUD AI does not warrant that RADAR will be uninterrupted, error-free, secure, or that it will meet your specific compliance requirements. RADAR is a tool designed to assist with compliance evidence collection — it does not guarantee regulatory compliance, and you remain solely responsible for your compliance obligations under applicable law. The entire risk arising from the use of RADAR rests with you.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall AKIOUD AI be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, business opportunities, or regulatory fines and sanctions (including under the GDPR or EU AI Act), arising out of or related to these terms or the use of RADAR.

The total aggregate liability of AKIOUD AI for all claims arising under these terms shall not exceed the total fees paid by you to AKIOUD AI in the twelve (12) months preceding the event giving rise to the claim. This is an aggregate cap on all claims and causes of action.

Nothing in this section limits or excludes liability for: (a) fraud or fraudulent misrepresentation, (b) death or personal injury caused by negligence, (c) breach of confidentiality obligations, (d) infringement of intellectual property rights, or (e) any liability that cannot be limited or excluded under applicable mandatory law.

10. Indemnification

You agree to defend, indemnify, and hold harmless AKIOUD AI, its affiliates, and their respective officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of RADAR in a manner that violates applicable law or these terms.
• Any data or content you process using RADAR.
• Your breach of any third-party rights, including intellectual property or data protection rights.

11. Fees and payment

License fees are as set forth on the pricing page or in your applicable order form. Fees are exclusive of all taxes, and you are responsible for any applicable VAT, sales tax, or similar charges. All fees are non-refundable except as expressly stated otherwise. AKIOUD AI may change its pricing with thirty (30) days' notice. Continued use after the change constitutes acceptance of the new pricing.

If you fail to pay fees when due, AKIOUD AI may suspend access to RADAR after seven (7) days' written notice. Late payments shall bear interest at the rate of three times the applicable legal interest rate in France, as provided by French law.

In accordance with French law (Article L441-10 of the Commercial Code), any late payment shall automatically trigger, in addition to late interest penalties equal to three times the legal interest rate, a mandatory fixed indemnity of forty euros (€40) for recovery costs. If the recovery costs incurred exceed forty euros, AKIOUD AI reserves the right to seek additional compensation upon justification.

12. Confidentiality

Each party agrees to maintain the confidentiality of any non-public information disclosed by the other party in connection with these terms. This obligation does not apply to information that: (a) is or becomes publicly available without breach, (b) was known prior to disclosure, (c) is independently developed, or (d) is required to be disclosed by law. This section survives termination for three (3) years.

13. Termination

You may stop using RADAR at any time. AKIOUD AI may suspend or terminate your access to RADAR immediately if you materially breach these terms and fail to cure within fifteen (15) days of notice. Upon termination, your license to use RADAR ends. Evidence you collected prior to termination remains yours and accessible in read-only mode. Sections 5, 7, 8, 9, 11, and 13 survive termination.

14. Force majeure

Neither party shall be liable for any delay or failure to perform its obligations under these terms due to events outside its reasonable control, including acts of God, war, terrorism, strikes, government actions, or large-scale infrastructure failures. The affected party shall provide prompt notice and resume performance as soon as reasonably possible.

15. Governing law and disputes

These terms are governed by French law. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Paris, France. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

16. General provisions

These terms constitute the entire agreement between you and AKIOUD AI regarding the use of RADAR. If any provision is found to be unenforceable, the remaining provisions remain in full effect. Failure to enforce any right does not constitute a waiver. You may not assign these terms without prior written consent. AKIOUD AI may assign these terms in connection with a merger, acquisition, or sale of assets.
